The Lubbock County District Attorney’s Office has 25 prosecutors, three of whom are specially trained in prosecuting cases involving sexual abuse of children.

Increased Prosecutions Lead to Increase in False Allegations

The DA’s office has ramped up its prosecution of sex offenses, especially those involving children. The Lubbock County district court has responded to this strict prosecution policy in child sex abuse cases with harsh prison sentences and hefty fines. A state court defendant was recently given a 40-year sentence for a child sexual assault while another defendant was given a 99-year term for continuous sexual assault of a child. A federal defendant was given a 293-month sentence for child sex trafficking.

The District Attorney’s Office in 2015 continued the prosecution in a child sexual assault case even after the victim recanted and told the jury she had lied about the defendant sexually abusing her. He was nonetheless convicted and received a 10-year prison term.

With increased emphasis on child sex abuse prosecutions by the DA’s office, there will be false allegations, especially in divorce proceedings involving contentious child custody disputes. Reputable studies reveal that false child sex abuse allegations are made in anywhere from 6 to 35 percent of these cases. Some of these will occur in Lubbock County.

This past June 2017 a Texas husband and wife were formally exonerated after spending 25 years in the state’s prison system on charges of sexually abusing children. Subsequent investigations established that not only had the couple not abused children, no crime had ever even occurred.
